Created in 2002, the Environment Protection Act (EPA) was then presented as a modern way to address a modern issue. A judicial tool to allow the protection of the environment and humankind, Where the whole country would participate in the preservation of the environment.
From there there has been some regressions in the practice of environmental law and the main issues are:
– The Locus Standi where the proof of personal prejudice must be set before the case can be lodged.
– The short leadtimes to react / lodge cases of appeal
