Environmental Law is not conceived to protect the environment but to bring a limiting frame to development by human beings. In Mauritius, the democracy of environmental justice is still to be proven; namely due to insufficient knowledge and education in environmental matters.

Judicial activism (activisme judiciaire) by the judges and the profession at large is necessary to an evolution in the proper direction.
